Terms and Conditions

If the customer pays a deposit to Design Tops and/or Design Tops begins the fabrication of the customer's countertop, the customer has agreed to the terms and conditions specified herein.

CONSTRUCTION AND FABRICATION INVOLVES MANY RISKS THAT ARE BEYOND DESIGN TOPS' CONTROL. ALL QUOTED LABOR AND MATERIALS ARE BASED ON ESTIMATES THAT ARE SUBJECT TO CHANGE DUE TO MANY UNFORESEEN CIRCUMSTANCES

a. All orders are subject to written acceptance by Design Tops.

b. Prices are subject to change in accordance with any changes to the quoted scope of work. The customer will be notified, orally or in writing (at Design Tops' discretion), and charged the price in effect at the time of order placement.

c. Design Tops will only perform work directly related to the fabrication and installation of the countertops - among other items outside of scope, this does not include:

a. Plumbing connections or disconnections

b. Electrical work

c. Caulking or wall work to uneven walls

d. Leveling cabinets

d. Unless specifically ordered, removals are not included in the quoted price. Standard countertop removals start at $250 for countertops under 40 square feet.

a. Payment in full is due at the time of install unless otherwise agreed upon in writing.

b. Accepted forms of payment include cash, check, ACH, and credit card. Credit card fees may apply for amounts greater than $10,000.

a. Orders may not be canceled once the deposit has been made.

a. Delivery dates are estimates and delivery time and duration of installation is not guaranteed.

b. The customer is responsible for ensuring the site is ready for installation and access to the installation area.

a. The customer is responsible for following proper maintenance and care of the installed countertops. Design Tops provides recommended care and maintenance guidance on its website www.designtops.com.

b. Failure to follow care instructions recommended by Design Tops and/or the manufacturer of your material may impact the longevity and appearance of the countertops.

Design Tops shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the fabrication, installation,and/or use of our countertops. The goods and services covered by these terms have been purchased by the customer "AS IS" and "WITH ALL FAULTS," and the customer acknowledges that Design Tops does not provide any warranty for the goods and services, including but not limited to the implied warranties that the goods are of merchantable quality or that goods can be used for any particular purpose.

Design Tops reserves the right to modify these terms and conditions at any time. Customers will be notified of any changes.

The customer's payment of a deposit to Design Tops or the customer's authorization for Design Tops to begin fabrication of the countertops constitutes the customer's acknowledgment of their receipt, understanding, and agreement with these terms.
